SRK have a first ranking mortgage on the property if the funds are not paid they will be in default and the asset will be then owned by srk and the debt will not need to be paid.
There is a fair chance D & C may not like this outcome but doesn't look like they have a strong possition.
SP is forcasting a long dispute ATM.
